The Refugee Convention provides refugees lawfully staying in the State the right to seek wage-earning employment, with treatment no less favourable than that given to the most favourably treated non-nationals. Many States, for example, lower restrictions for nationals of neighbouring States under regional labour agreements. States are encouraged, however, to grant refugees, including asylum-seekers, equal access to employment as nationals, particularly where refugees enter through labour recruitment or immigration programmes. The 1954 Statelessness Convention provides that stateless persons lawfully staying in the country should be treated as favourably as possible when it comes to the right to engage in wage-earning employment, and in any event not less favourably as non-nationals generally in the same circumstances. Refugees and stateless persons may not be arbitrarily restricted from certain sectors of the economy nor may States impose restrictive fees on refugees and stateless persons to access wage-earning employment. As citizens and residents of the country where they are displaced, IDPs may not be discriminated against in the enjoyment of the right to work due to their displacement.

Under international human rights law, States are allowed to restrict access to wage-earning employment of non-nationals, including refugees and stateless persons, in a number of circumstances, provided such limitations are reasonable and necessary. Commonly accepted restrictions include: economic necessity (e.g. underdevelopment or poor economic conditions); restrictions based on the length of residence or status of a refugee or stateless person; delays or sector-specific restrictions for reasons of public order or national security (e.g. to allow for identity or security verification); and prohibitions on employment for those engaged or those justifiably suspected of activities prejudicial to the security of the State. The principle of progressive realisation requires States to reduces such limitations over time.  Where restrictions are gradually eased, or at least not expanded, they may be considered be appropriate. The Refugee Convention provides that restrictions to protect the labour market may not be imposed on refugees lawfully staying in the country who have resided in the country for at least three years, or who have a spouse or child who is a national of the country.

In addition, no person, including those who are forcibly displaced or stateless, may be unfairly deprived of employment or arbitrarily dismissed.
