Country context

Mauritius is an island nation located in the Indian Ocean, approximately 2,000 km southeast of mainland Africa and east of Madagascar. The Republic includes the main island and several smaller outlying islands within an extensive exclusive economic zone. 

The international legal framework regarding refugee protection in Mauritius remains ambiguous. Mauritius is not a party to the 1951 Refugee Convention or its 1967 Protocol, nor has it deposited instruments of accession. However, the Supreme Court of Mauritius ruled in 2003 that the country succeeded to these obligations upon gaining independence in 1968. Despite this interpretation, no dedicated domestic asylum law has been enacted. Mauritius has signed, but not ratified, the 1969 OAU Convention.

While not a traditional host country for large displaced populations, Mauritius hosts a small number of refugees and asylum seekers of mixed nationalities, primarily from Burundi, the Democratic Republic of the Congo, Cameroon, and the Syrian Arab Republic.

Mauritius has no designated refugee camps or formal reception centres. Asylum seekers and refugees reside in private accommodations in urban and semi-urban areas across the country. Access to services such as education, health care, and livelihoods is mediated through immigration permits, which are subject to case-by-case administrative discretion. There is currently no national refugee status determination (RSD) system, and protection needs are addressed under general immigration law, most recently consolidated in the Immigration Act of 2022. The absence of a national asylum law or RSD system means that refugee protection remains ad hoc and discretionary.

On statelessness, Mauritius is not a party to the 1954 Convention on the Status of Stateless Persons or the 1961 Convention on the Reduction of Statelessness. There is no dedicated statelessness determination procedure, and nationality matters are governed by the Civil Status Act and related regulations. 

Mauritius has achieved universal birth registration, with a robust civil registration system. This achievement significantly reduces the risk of statelessness and ensures that all children have legal identity from birth. However, gaps remain in aligning the legal framework with international standards.
