TERMS AND CONDITIONS OF USE – RiMAP [for unhcr staff &partners]

Use of the Rights Mapping and Analysis Platform (together, “RiMAP” or the “Platform”), constitutes acceptance of the following terms and conditions. 

  1. The Platform

The information presented within the Platform is made available to authorized users (“Users”) for the performance of their official duties. All content, including documents, photographs, video, or audio materials (collectively “Materials”) on RIMAP is made available by UNHCR for internal use within the Organization or the relevant partner agency without any right to resell or redistribute the Materials or to compile or create derivative works therefrom. Extracts of the information in this Platform may be reviewed, reproduced, or translated for UNHCR mandate-related purposes, including research, but not for sale or for use in conjunction with commercial purposes. Any use of the Materials from the Platform shall be accompanied by an acknowledgment of the source, citing the uniform resource locator (URL) of the text.

Any use other than those described above, including reproduction or translation of substantial portions of the Materials of the Platform, requires the express prior written permission of UNHCR and, if applicable, the permission of the relevant publishers and/or authors holding copyrights on the Materials. All Materials of the Platform are protected by law including, as applicable, copyright laws. UNHCR and relevant copyright holders reserve the right to seek all remedies available by law for any violation of these terms and conditions of use, including any violation of rights in their names and emblem and as well as their rights in connection with the information, artwork, text, video, audio, or photo materials of the Platform.

The Materials are selected based on UNHCR’s established criteria for inclusion and in its own sole discretion. UNHCR periodically adds, changes, improves, or updates the Materials on this Platform without notice. UNHCR reserves the right at any time to change or discontinue any aspect or feature of RiMAP, including but not limited to these terms of use, hours of availability and equipment needed for use. 

2. Disclaimer

UNHCR is not responsible for, nor does it necessarily endorse, the content of the Materials available on RiMAP.

Unless expressly stated otherwise, the findings, interpretations and conclusions expressed in the Materials on this Platform are those of the various UNHCR staff members, consultants, and advisers to UNHCR or UNHCR partners and/or contributors who prepared them and do not necessarily represent the views of the United Nations, including UNHCR or other UN-system organizations, or their Member States. The responsibility for opinions expressed in signed articles, studies and other contributions made available on this Platform do not in any way represent UNHCR doctrinal position, and their release on the Platform does not constitute an endorsement by the United Nations or UNHCR of the opinions and findings expressed therein.

Under no circumstances shall UNHCR be liable for any loss, damage, liability, or expense incurred or suffered that is claimed to have resulted from the use of this Platform, including, without limitation, any fault, error, omission, interruption, or delay with respect thereto. The use of this Platform is at the User’s sole risk. 

UNHCR does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information provided by any information provider, any user of this Platform or any other person or entity. Reliance upon any such advice, opinion, statement, or other information shall be at the User's own risk. Neither UNHCR nor its entities, nor any of their respective agents, employees, information providers or content providers, shall be liable to any User or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness, nor shall they be liable for any failure of performance, computer virus or any other contamination, or communication line failure, regardless of cause, or for any damages resulting therefrom.

As a condition of use of this Platform, the User agrees to indemnify UNHCR from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of the User's use of this Platform, including, without limitation, any claims alleging facts that if true would constitute a breach by the User of these Terms of Use.

This Platform may contain links and references to third-party websites. The linked websites are not under the control of UNHCR, and UNHCR is not responsible for the validity or accuracy of content posted on any linked website or any link contained in a linked website, including their privacy practices. UNHCR provides these links only for research purposes, and the inclusion of a link or reference does not imply the endorsement of the linked website by UNHCR.

5. Name and Emblem of UNHCR and Partners

The names, emblems and logos of UNHCR and its partners are their exclusive property. They are protected under national and international law. Unauthorized use is prohibited. They may not be copied or reproduced in any way without the prior written permission of the entity concerned.

 6. Preservation of Immunities

Nothing herein shall constitute or be considered to be a limitation upon or a waiver of the privileges and immunities of the United Nations, including UNHCR and other UN-system organizations, or their member States as providers of Materials made available on this Platform, and are specifically reserved.

7. General

UNHCR reserves its exclusive right in its sole discretion to alter, limit or discontinue the Platform or any Materials in any respect. UNHCR shall have no obligation to take the needs of any User into consideration in connection therewith.

UNHCR reserves the right to deny in its sole discretion any user access to this Platform or any portion thereof without notice. No waiver by the UNHCR of any provision of these Terms and Conditions of Use shall be binding except as set forth in writing and signed by its duly authorized representative.

The use of particular designations of countries or territories and related data shown on maps and included in lists, tables or documents on this Platform does not imply the expression of any opinion whatsoever on the part of UNHCR, the United Nations or other UN-system organizations, concerning the legal status of such countries or territories, of their authorities and institutions, or concerning the delimitation of their frontiers or boundaries.

 

Responsibility for User- Generated Content

Conditions to Upload Content on RiMAP 

When you as a user share content within RiMAP, you must only submit/share your own original content. If your content contains the work(s) of others (e.g. music, images and/or video) you must have obtained the necessary rights or permissions to use that material. In addition, you have the obligation to ensure that the content you share does not contain information relating to an identified or identifiable person unless you have obtained her/his consent, or in case of a minor her/his guardian’s consent. 

UNHCR also requires that you do not submit or share any material or information:

  1.  That is knowingly false or misleading, defamatory, infringing, obscene, indecent, threatening or invasive of a person’s privacy or unlawful in any way;
  2.  Which you do not own or for which you have not obtained all necessary licences and/or approvals as may be required by law;
  3. Which is technically harmful (including, without limitation, files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another’s computer); 
  4.  Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with anyone or any entity.
  5.  Deleting any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;
  6.  Falsifying the origin or source of software or other material contained in a file that is uploaded;
  7.  Advertising or offering to sell any goods or services, or conducting or forwarding surveys, contests or chain letters, or downloading any file posted by another User of the Platform that you know, or reasonably should know, cannot be legally distributed in such a manner.

Any inappropriate content will be rejected or removed from this Platform. If in doubt, please do not share your content. If you post on, or transmit to, on this Platform any material of the type prohibited under the above paragraphs or any applicable laws and regulations, and UNHCR incurs any costs, expenses, liability, or losses as a result, then you agree to indemnify UNHCR for all such costs, expenses, liability or losses.

You should be aware that UNHCR is entitled to reveal your identity (or any information which it has about you) to any third party who is claiming that any of that content shared with UNHCR violates any of their rights, or to any government or regulatory authority that may request UNHCR to do so to the extent permitted under UNHCR’s internal rules and policies, including its personal data protection and privacy framework.
