Description

The purpose of this Regulation is to elaborate the procedures and mechanisms for the implementation of the Migration and Aliens Law.

Selected provisions
Article 45 - Refugees

The General Directorate of Migration and Foreign Affairs shall grant a special permanence permit to foreigners who have been recognized as refugees when they fall under the following cases: 1. Due to well-founded fears of being persecuted for reasons of race, religion, nationality, membership in a particular social group, or political opinions, they are outside the country of their nationality and are unable or, owing to such fears, unwilling to avail themselves of the protection of that country; 2. Due to being stateless and for the reasons set forth in the preceding numeral, they are outside the country in which they had their habitual residence, and are unable or, owing to such fears, unwilling to return to it; 3. They have fled their country because their life, safety, or freedom has been threatened by any of the following reasons: a) Generalized, serious, and continuous violence; b) Foreign aggression understood as the use of armed force by a State against the sovereignty, territorial integrity, or political independence of the country of origin; c) Internal armed conflicts arising between the armed forces of the country from which they flee, and armed forces or groups; d) Massive, permanent, and systematic violation of human rights; e) They suffer persecution through sexual violence or other forms of gender-based persecution grounded in violations of human rights enshrined in international instruments. 4. All those persons who directly depend on the refugee and who constitute a family group shall also be considered refugees; likewise, persons who accompany the refugee or have joined them subsequently, provided they are under their dependence. Furthermore, foreigners who are legally within Honduran territory and feel threatened by the reasons expressed in the preceding article may request a special permanence permit as refugees. Applications shall be submitted to the General Directorate of Migration and Foreign Affairs or to the Migration Delegations, which shall forward the applications to the central office for resolution.
ARTICULO 45.- REFUGIADOS. La Dirección General de Migración y Extranjería otorgará permiso especial de permanencia a los extranjeros a quienes les haya reconocido su condición de refugiado cuando se encuentren en los casos siguientes: 1. Por fundados temores de ser perseguidos por motivos de raza, religión, nacionalidad, pertenencia a determinado grupo social u opiniones políticas, se encuentren fuera del país de su nacionalidad y no puedan o no quieran acogerse a la protección de ese país debido a dichos temores; 2. Por carecer de nacionalidad y por los motivos expuestos en el numeral anterior, se encuentren fuera del país en el que tenían residencia habitual, y no puedan o no quieran regresar a él; 3. Que hayan huido de su país porque su vida, seguridad o libertad se han visto amenazadas por cualquiera de los motivos siguientes: a) Violencia generalizada, grave y continua; b) Agresión extranjera entendida como el uso de la fuerza armada por parte de un Estado contra la soberanía, la integridad territorial o la independencia política del país de origen; c) Conflictos armados internos suscitados entre las fuerzas armadas del país del que se huye, y fuerzas o grupos armados; d) Violación masiva, permanente y sistemática de los derechos humanos; e) Que sufran persecución mediante violencia sexual u otras formas de persecución de género basada en violaciones de derechos humanos consagrados en instrumentos internacionales. 17 4. También serán considerados como refugiados todas aquellas personas, que dependan directamente del refugiado y que constituyan un grupo familiar; asimismo, las personas que acompañen al refugiado o se hayan unido a él posteriormente, siempre y cuando se encuentren bajo su dependencia. Asimismo, podrán solicitar permiso especial de permanencia como refugiados los extranjeros que encontrándose legalmente en territorio hondureño se sientan amenazados por los motivos expresados en artículo anterior. Las solicitudes se presentarán ante la Dirección General de Migración y Extranjería o ante las Delegaciones Migratorias, las cuales remitirán las solicitudes a la oficina central para su resolución.

Article 47 - Investigations

The General Directorate of Migration and Foreign Affairs, in coordination with officials from the liaison office of the United Nations High Commissioner for Refugees (UNHCR), shall carry out the relevant investigations with the aim of determining the veracity of the information provided by the applicant, who may present the documentation they deem necessary when possible. While the General Directorate of Migration and Foreign Affairs rules on the case, the Department of International Migrations shall authorize the temporary stay of the requesting foreigner for a period not exceeding ninety (90) days, extendable for thirty (30) days when necessary. The Department of International Migrations, through the Refugees Section, shall establish the procedures and formats to be used for initial interviews, inquiries, and stay permits in the country.

"ARTÍCULO 47.- DE LAS INVESTIGACIONES. La Dirección General de Migración y Extranjería en coordinación con funcionarios de la oficina de enlace del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR), llevarán a cabo las investigaciones pertinentes con el objetivo de determinar la veracidad de la información brindada por el solicitante, quien podrá presentar la documentación que considere necesaria cuando fuere posible. Mientras la Dirección General de Migración y Extranjería se pronuncia sobre el caso, el Departamento de Migraciones Internacionales, autorizará la permanencia temporal del extranjero solicitante por un período no mayor a los noventa (90) días, prorrogables por treinta (30) días cuando fuere necesario. El Departamento de Migraciones Internacionales por medio de la Sección de Refugiados, establecerá los procedimientos y formatos que se utilizarán para las entrevistas, indagaciones y permisos de permanencia iniciales en el país. ARTÍCULO 116.- DEL TIEMPO DE PERMANENCIA INICIAL.
La Dirección General de Migración y Extranjería podrá autorizar la permanencia inicial de un extranjero no
residente en la forma siguiente:
1. Viajeros en vías de deportes, convenciones, salud, conferencias, científicos, eventos especiales,
delegados o representantes comerciales, agentes viajeros y artistas de espectáculos públicos, treinta (30)
días.

2. Trabajadores migrantes temporales, trabajadores transfronterizos y tripulantes de transporte
internacional, treinta (30) días.
3. Turistas, misión oficial, visitantes especiales, solicitantes de refugio y de asilo, noventa (90) días.
3. Viajeros en tránsito tres (3) días.
Las disposiciones anteriores se aplicarán sin perjuicio a lo establecido en acuerdos, convenios o tratados
internacionales y en circulares o disposiciones que emita la Secretaría de Estado en los Despachos de
Gobernación y Justicia o la Dirección General de Migración y Extranjería"

Article 146 - ADMINISTRATIVE REMEDIES

Regarding the challenging of resolutions and measures, it shall be subject to the remedies provided for in the Administrative Procedure Act.

"ARTÍCULO 146.- DE LOS RECURSOS ADMINISTRATIVOS.
En cuanto a la impugnación de resoluciones y providencias se sujetará a los recursos previstos en la Ley de Procedimiento Administrativo."

Article 42 - COMPLEMENTARY INTERNATIONAL PROTECTION STATUSES

"ARTICLE 42.- SPECIAL PERMITS OF PERMANENCE. The General Directorate of Migration and Aliens may grant special permits of permanence in the country for up to a maximum of five years, to foreigners who request it for justified reasons based on the following grounds:
1 | Students at any level of the national education system, including individuals undertaking professional internships;
2 | Refugees and stateless persons;
3 | Asylees;
4 | Migrant workers with a stay exceeding three months;
5 | Foreigners performing social service;
6 | Religious personnel;
7 | Foreigners voluntarily providing humanitarian and charitable services to the country;
8 | Foreigners engaged in commercial activities or public entertainment/shows;
9 | Foreigners hired as temporary employees by a natural or legal person;
10 | Scientists, professionals, athletes, and technical or specialized personnel, hired by natural or legal persons established in the country;
11 | Business owners, managerial personnel of national or foreign mercantile corporations authorized to conduct business in the country;
12 | Spouse and dependent minor or adult children, grandparents, and parents of the persons described in the preceding items;
13 | Members of churches whose highest authorities have signed migration facilitation agreements with the Secretariat of Governance and Justice;
14 | Foreigners hired for projects or programs funded by the Honduran Government, foreign governments, international organizations, or governmental institutions; and,
15 | Any others that the General Directorate of Migration and Aliens deems appropriate, based on reasons of national interest, humanitarian grounds, or reciprocity with other States. | Natural or legal persons, public or private, are required to notify, within a period not exceeding five business days, the termination of the relationship with the foreigner that motivated the granting of the special permit of permanence for the migratory categories comprised from item 4 to item 13 of this article."

ARTICULO 42.- PERMISOS ESPECIALES DE PERMANENCIA. La Dirección General de Migración y Extranjería podrá conceder permisos especiales de permanencia en el país hasta por un máximo de cinco años, a extranjeros que por causas justificadas lo soliciten por los motivos siguientes: (…) 15. Los demás que la Dirección General de Migración y extranjería estime conveniente, en razones de interés nacional, humanitarias o en reciprocidad con otros Estados. (…)

Article 80 - GROUNDS FOR LOSS OF RESIDENCY OR SPECIAL PERMIT FOR PERMANENCE.

"Resident foreigners or those holding a special permit for permanence shall lose their status as such in the following cases:
1. Due to duly proven falsehood in statements, reports, or documents submitted with the application;
2. Due to non-compliance with the obligations established in the Law of Migration and Foreign Affairs or these Regulations;
3. When resident foreigners remain outside the country for more than twelve consecutive months without the permission of the General Directorate of Migration and Foreign Affairs; and,
4. When foreigners holding a special permit for permanence remain outside the country for more than six consecutive months without the permission of the General Directorate of Migration and Foreign Affairs."
"ARTÍCULO 80.- MOTIVOS POR LOS QUE SE PIERDE LA RESIDENCIA O EL PERMISO ESPECIAL DE PERMANENCIA Los extranjeros residentes o con permiso especial de permanencia, perderán su condición de tales por los casos siguientes:
1. Por falsedad debidamente comprobada en declaraciones, informes o documentos presentados en la solicitud;
2. Por incumplimiento de las obligaciones establecidas en la Ley de Migración y Extranjería o el presente Reglamento;
3. Por permanecer los extranjeros residentes fuera del país por más de doce meses consecutivos sin el permiso de la Dirección General de Migración y Extranjería; y,
4. Por permanecer los extranjeros con permiso especial de permanencia, fuera del país por más de seis meses consecutivos sin el permiso de la Dirección General de Migración y Extranjería."

Article 55 - VOLUNTARY REPATRIATION

"Refugees who voluntarily wish to return to their country of origin or habitual residence may do so through voluntary repatriation, for which they must express this in writing before the Department of International Migrations of the General Directorate of Migration and Foreign Affairs.
The request for voluntary repatriation shall contain the express statement of the refugee, clearly determining the reasons for which it is requested and the certainty that their personal integrity will be guaranteed, releasing the State of Honduras from any liability for any event subsequent to the repatriation.
The Department of International Migrations, in coordination with the United Nations High Commissioner for Refugees (UNHCR), shall carry out the voluntary repatriation and shall ensure that it is conducted under the best conditions of safety and respect for the person."

ARTÍCULO 55.- REPATRIACIÓN VOLUNTARIA. Los refugiados que voluntariamente deseen regresar al país de origen o de residencia habitual, podrán hacerlo mediante la repatriación voluntaria, debiendo para ello manifestarlo por escrito ante el Departamento de Migraciones Internacionales de la Dirección General de Migración y Extranjería. La solicitud de repatriación voluntaria contendrá la manifestación expresa del refugiado, determinando de manera clara los motivos por los cuales la solicita y la certeza que su integridad personal será garantizada, liberando de responsabilidad al Estado de Honduras por cualquier acontecimiento posterior a la repatriación. El Departamento de Migraciones Internacionales en coordinación con el Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR), efectuarán la repatriación voluntaria y velarán por que ésta se realice en las mejores condiciones de seguridad y respeto hacia la persona.

Article 116 - Initial Length of Stay

ARTICLE 116.- OF INITIAL LENGTH OF STAY. The General Directorate of Migration and Aliens may authorize the initial stay of a non-resident foreigner as follows: 1. Travelers on grounds of sports, conventions, health, conferences, scientists, special events, commercial delegates or representatives, traveling agents, and public show performers, thirty (30) days. 2. Temporary migrant workers, cross-border workers, and international transport crew, thirty (30) days. 3. Tourists, official missions, special visitors, applicants for refugee and asylum status, ninety (90) days. 4. Transit travelers, three (3) days."
