Description

The Ordinance on the Temporary Exemption from the Requirement for a Residence Permit for Persons Who Entered Due to the War in Ukraine (Ukraine-Aufenthalts-Übergangsverordnung) is a special legal measure adopted by Germany in response to the humanitarian crisis caused by the conflict in Ukraine. This ordinance provides a temporary exemption from the usual requirement of obtaining a residence permit for individuals fleeing the war in Ukraine and seeking refuge in Germany.

Enacted as an emergency response, the ordinance allows Ukrainian nationals and other eligible persons who entered Germany because of the war to stay in the country without immediately needing a formal residence permit. The ordinance outlines the specific conditions and duration of this exemption, typically allowing a stay without a residence permit for a specified period, during which time the affected individuals are encouraged to apply for appropriate residence status, such as temporary protection or asylum.

Moreover, the ordinance ensures that individuals benefiting from this exemption have access to basic rights and services, such as housing, healthcare, and social support, while they are in Germany.
