Description

Act XC of 2023 on the General Rules for Entry and Stay of Third-Country Nationals (TCN Act) provides for detention pending deportation and detention pending deportation, the conditions for their order and the rules for their enforcement. The legislation also contains a number of procedural guaranties such as the fact that detention cannot be ordered solely on the grounds that the third-country national has lodged an asylum application and that detention must be lifted immediately if the reason for its imposition ceases to exist. The legislation underlines that detention of a person under the age of 16 may be ordered only in exceptional cases and then for a maximum period of 30 days.
