Description

The Constitution of Serbia establishes the legal and political framework of the country. It outlines the fundamental rights and freedoms of individuals, the structure of government, and the relationships between the state and its citizens. The right to asylum is outlined in the Constitution, where Article 57 states that any foreign national who has a legitimate fear of persecution due to their race, gender, language, religion, national origin, affiliation with a particular group, or political beliefs is entitled to seek asylum in the Republic of Serbia.

Article 57- Right to asylum

Any foreign national with reasonable fear of prosecution based on his race, gender, language, religion, national origin or association with some other group, political opinions, shall have the right to asylum in the Republic of Serbia.

The procedure for granting asylum shall be regulated by the law.
