Description

The Criminal Code of Turkmenistan aims to protect the rights, freedoms, and legitimate interests of individuals and citizens; safeguard property, public order, public safety, and the environment; ensure the independence, constitutional order, territorial integrity, and permanent neutrality of Turkmenistan; and defend the interests of society, the state, and global peace and security from criminal threats. It also serves to prevent crime. To achieve these objectives, the Code establishes the grounds and principles of criminal liability, defines which publicly dangerous acts constitute crimes, and sets out punishments and other criminal law measures applicable for their commission.

Selected provisions
Article 235-Illegal crossing of the State Border of Turkmenistan

1. Crossing the protected State Border of Turkmenistan without the established documents and proper permission, shall be punishable by correctional labor for up to two years or imprisonment for up to two years with or without the obligation to reside in a certain area for a period of one to three years.

2. Illegal crossing of the protected State Border of Turkmenistan, committed repeatedly or by a group of persons by prior agreement or by an organized group with the use of violence or the threat of violence, shall be punishable by imprisonment for up to five years with or without the obligation to reside in a certain area for a period of one to three years.

Note

This article shall not apply to cases of arrival in Turkmenistan in violation of the rules for crossing the State Border of Turkmenistan of foreign citizens and stateless persons to exercise the right of political asylum in accordance with the Constitution of Turkmenistan, unless the actions of these persons contain another element of a crime.
