Guinea, located in West Africa, shares borders with Guinea-Bissau, Senegal, Mali, Côte d'Ivoire, Liberia, and Sierra Leone. 

Guinea has ratified the 1951 Convention relating to the Status of Refugees and its 1967 Protocol. Guinea has also ratified the 1969 African Union Convention Governing the Specific Aspects of Refugee Problems in Africa and is a party to the 1954 International Convention relating to the Status of Stateless Persons the 1961 Convention on the Reduction of Statelessness, and the 2009 Kampala Convention on the Protection and Assistance of Internally Displaced Persons (IDPs).

In 2018, Guinea adopted Law L/2018/050/AN regarding Asylum and the Protection of Refugees, which provides a legal basis for granting asylum and refugee status. This law is considered as one of the most comprehensive in the West African region. It defines the management of refugees and asylum-seekers, including the roles of the Permanent Eligibility Committee and the Appeals Committee. It provides for protection and assistance measures for refugees, such as access to biometric documents (refugee identity cards, travel documents) and the possibility of applying for naturalization. In June 2021, a group of Government experts validated the implementing texts for this law. However, to date, no implementing decree for this law has been published for its effective implementation.

The Guinean Government renewed commitments during the Global Refugee Forum in 2023 to, inter alia: strengthen the functioning of the asylum system and maintain its integrity; facilitate access to healthcare for 500 vulnerable refugees per year; and develop a law on the protection of stateless persons and the procedure for determining the status of stateless persons. 

Guinea's legal framework addresses statelessness through the 1961 Convention on the Reduction of Statelessness. In 2021, the Ministry of Justice developed the first draft of a bill concerning the protection of stateless persons and the procedure for determining statelessness in the Republic of Guinea. The draft was submitted to the members of the National Transitional Council for their consideration.

Guinea is a party to the 2009 Kampala Convention, which outlines the rights and protections for IDPs. However, the country faces challenges in implementing the provisions of this convention due to limited resources and institutional capacity. The absence of a national legal framework specifically addressing IDPs further complicates efforts to provide adequate protection and assistance to displaced populations.
