Description

Refugee and asylum laws do not provide for special procedures for appealing the rejection of an asylum application. Instead, the standard procedure must be applied, which puts applicants at a disadvantage.

Article 85 - Right to Appeal

(Unofficial translation) Interested parties may file the appeals referred to in this chapter against any administrative act that terminates a procedure, prevents its continuation, causes defenselessness, or prejudges it as definitive, when said act infringes their subjective rights or legitimate, personal, and direct interests.

"Los interesados podrán interponer los recursos a que se refiere este capítulo contra todo
acto administrativo que ponga fin a un procedimiento, imposibilite su continuación, cause indefensión
o lo prejuzgue como definitivo, cuando dicho acto lesione sus derechos subjetivos o intereses
legítimos, personales y directos."

Article 9 - Motivation of administrative acts

(Unofficial translation) Administrative acts of a particular nature must be justified, except for those of a purely procedural nature or unless expressly provided otherwise by law. To this end, they must refer to the facts and the legal grounds for the act.

Los actos administrativos de carácter particular deberán ser motivados, excepto los de simple trámite o salvo disposición expresa de la ley. A tal efecto, deberán hacer referencia a los hechos y a los fundamentos legales del acto.
