Country context
Argentina is a country located in South America, bordered by Chile and the Andes Mountains to the west, Bolivia and Paraguay to the north, Brazil and Uruguay to the northeast, the South Atlantic Ocean to the east, and the Drake Passage to the south. The country has a legal system rooted in civil law traditions, influenced by European legal frameworks.
Argentina is signatory to the 1951 Refugee Convention and its 1967 Protocol, as well as the 1954 Convention relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness. Argentina's legal framework for the protection of forcibly displaced persons is primarily governed by Law No. 26,165 (enacted in 2006) which in general terms aligns in general with international standards and the 1984 Cartagena Declaration broader refugee definition. It established the interministerial National Refugee Commission (CONARE) which oversees asylum procedures and protection.
...The Refugee Law, which ensures access to asylum procedures, prohibits refoulement, and grants refugees the right to education, healthcare, and employment was amended by a Necessity and Urgency Decree (DNU) N° 942/2024 introducing substantial modifications to the refugee status determination due process, including restriction to the appeal procedure scope and timeframe, and to the cessation and exclusion provisions that originally mirrored those of the 1951 Convention.
Additionally, Argentina's Migration Law No. 25,871 (2003) was modified by a recently adopted Necessity and Urgency Decree (DNU) N° 366/2025, that establishes restrictions in the access to fundamental rights for certain migratory categories (e.g. excluding temporary migrants from the access to public and free health services), reforms the appeal procedures, and broadens the spectrum of reasons for the rejection at the border and the expulsion of foreign nationals. The said DNU does not incorporate international protection safeguards for asylum seekers or refugees.
In 2019, Argentina enacted Law No. 27,512 – the General Law for the Recognition and Protection of Stateless Persons. This legislation introduced a statelessness determination procedure, allowing individuals to apply for recognition of their status as stateless persons. It aims to prevent and reduce statelessness by providing a legal framework for the identification and protection of stateless individuals. It also facilitates access to nationality for those recognized as stateless, aligning with Argentina's commitments under international conventions.
