Cabo Verde, an archipelago located approximately 570 km off the west coast of Africa, comprises ten main islands and several islets, covering a total land area of about 4,033 km². The country shares maritime boundaries with Senegal, Guinea-Bissau, and other West African nations. Its geographical location has historically made it a point of transit for migrants and refugees, primarily from the Horn of Africa and the Sahel region.
Cabo Verde is not a party to the 1951 Convention relating to the Status of Refugees but it ratified its 1967 Protocol in 1987, by way of which Cabo Verde agrees to apply articles 2 to 34 of the Convention to refugees defined in article 1 thereof. Additionally, the country has not signed or ratified the 1954 Convention relating to the Status of Stateless Persons or the 1961 Convention on the Reduction of Statelessness.
...Cabo Verde does have a national law on asylum. Law n°99/V/99 defines the legal regime for asylum and refugee status. However, there is no institutional framework or mechanism in place for the determination of refugee status or statelessness. In addition to Law 99, Decree-Law 2/2015 authorizes border authorities to issue a single travel document for foreign citizens, refugees, and stateless persons, at their request, to guarantee means for their exit from the country.
Cabo Verde's nationality law is primarily based on the principles of jus soli and jus sanguinis. The Constitution and the Nationality Act of 1992, along with its amendments, govern the acquisition of nationality. While the law allows for the acquisition of nationality through birth or naturalization, it does not explicitly address the prevention of statelessness. The country has not adopted a national action plan to address statelessness, and there is no formal procedure for determining statelessness or providing protection to stateless individuals.
Cabo Verde is not a signatory to the 2009 African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (Kampala Convention). There is no national legislation or institutional framework specifically addressing the protection and assistance of internally displaced persons (IDPs). While the country has experienced internal displacement due to natural disasters, such as storms, there are no formal systems in place to support IDPs.
In its 2018 Universal Periodic Review (UPR) submission, a recommendation was made for Cabo Verde to amend its nationality law; this to enable children born in the country who would otherwise be stateless to acquire Cabo Verdean nationality.
