Country context

Equatorial Guinea, located on the west coast of Central Africa, comprises a mainland region (Río Muni) and several islands, including Bioko Island. It shares land borders with Cameroon and Gabon and has maritime boundaries with several countries in the Gulf of Guinea. The country population is predominantly urban, with the capital city, Malabo, situated on Bioko Island.  Equatorial Guinea's location in Central Africa places it within regional mixed migration patterns. 

Equatorial Guinea is a party to 1951 Refugee Convention and its 1967 Protocol as well as the 1969 OAU Convention Governing the Specific Aspects of Refugee Problems in Africa. However, the country does not have a specific domestic legal framework for the determination of refugee status or the protection of refugees. As a result, there are no formal procedures for asylum seekers to apply for refugee status, and no established rights or entitlements for refugees. In respect of statelessness, the country is bound by the 1954 Convention relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness, having deposited its instruments of accession in April and June 1969, respectively.

The country's nationality law, as outlined in the Constitution and the Equatoguinean Nationality Regulation, determines who is eligible for nationality. Nationality can be acquired by birth within the country's territory (jus soli), by descent from Equatoguinean parents (jus sanguinis), or through naturalization. While these provisions aim to prevent statelessness, challenges remain in ensuring that all individuals at risk of statelessness are recognized and protected, but there is no comprehensive legal procedure for identifying or addressing statelessness in practice.

In 2019, Equatorial Guinea acceded to the Kampala Convention, the African Union Convention for the Protection and Assistance of Internally Displaced Persons (IDPs) in Africa. This accession demonstrates the country's commitment to addressing the needs of IDPs and aligning with internal displacement regional standards.
