Country context
San Marino is a landlocked microstate surrounded by Italy. Forcibly displaced people in San Marino have historically been very few. Refugees and asylum-seekers' access to housing, healthcare and other services is arranged under prevailing immigration and civil-residency provisions, with no specialized reception facilities.
San Marino is not a party to either the 1951 Convention relating to the Status of Refugees or its 1967 Protocol. San Marino has not ratified the 1954 Convention relating to the Status of Stateless Persons or the 1961 Convention on the Reduction of Statelessness. Article 1 of Law 8 July 1974, no. 59 (“Declaration of the rights of citizens and fundamental principles of Sammarinese legal order”) restates the right to “political asylum”. There is no specific law, however, detailing the legal requirements for being granted asylum, or clarifying the applicable procedure. Law no. 118/2010 empowers the Congress of State to exceptionally issue residence permits “for humanitarian reasons of social protection". Legislative amendments expanded the scope of these permits, in 2016, to victims of trafficking and violence.
