Analysis

Law 6458 on Foreigners and International Protection, Article 64(1)(b) provides that an applicant is excluded from international protection where they are recognized by the competent authorities of the country in which they reside as having the rights and obligations enjoyed by that country’s nationals. This ground corresponds in substance to the 1951 Convention Article 1E rationale, namely that a person who already enjoys national like protection in a third country is not in need of international protection in Türkiye.

Law 6458 on Foreigners and International Protection does not set additional conditions, such as fees, for the application of this exclusion ground. The legal test turns on the fact of recognition by the competent authorities of the state of residence and the content of the status recognized, namely rights and obligations comparable to nationals.

Law 6458 on Foreigners and International Protection does not create different treatment among refugees on grounds such as age, gender, or diversity within Article 64(1)(b). Any differential impact arises from the person’s prior residence situation and legal position in another country, rather than from personal characteristics protected as such.
