Do domestic laws and policies provide for the cessation of refugee status?
Assessment by population
Analysis
Domestic law regulates cessation, of international protection status under the Law 6458 on Foreigners and International Protection, Article 85.
Law 6458 on Foreigners and International Protection, Article 85(1) provides that international protection status ends where the beneficiary:
a) voluntarily re-avail themselves of the protection in their country of citizenship;
b) voluntarily regain the citizenship that they have been deprived of;
c) acquired a new nationality, and enjoy the protection of the country of their new nationality;
d) voluntarily returned to the country from which they have fled or stayed outside of due to fear of persecution;
e) would avail himself or herself of the protection of the country of citizenship as the circumstances on which the status had been granted no longer apply;
f) having been a stateless person would able to return to the country of former habitual residence as the circumstances on which the status had been granted no longer apply;
g) without prejudice to the provisions of Article 84, if they voluntarily leave Türkiye, benefit from the protection of a third country, are admitted to a third country for humanitarian reasons or within the scope of resettlement, exit to a third country, or die.
For cessation based on changed circumstances, Law 6458 on Foreigners and International Protection, Article 85(2), requires assessment of whether the circumstances have changed significantly and permanently.
For subsidiary protection, Article 85(3) separately addresses cessation where protection is no longer needed and again requires consideration of whether the change is significant and permanent.
Law 6458 on Foreigners and International Protection, Article 85(4) provides that where the relevant circumstances arise, the status may be reassessed. The reassessment must be notified in writing with reasons, and the person must be given an opportunity to present reasons for continuation of status verbally or in writing.
Law 6458 on Foreigners and International Protection, Article 85(5) requires that the cessation decision be notified together with its material reasons and legal grounds, and that unrepresented persons be informed of consequences and appeal procedures and time limits.
Article 85 does not introduce differentiated cessation criteria by age, gender, or other personal characteristics. The only structured differentiation is that Article 85(3) contains subsidiary protection specific termination language.
Cessation ends the status on a forward-looking basis. As with cancellation, this removes the legal basis for documentation tied to status, including the identity document under Article 83 and, for refugees, the Convention travel document under Article 84.
Article 85 does not set out a dedicated rule on derivative effects for family members. Implementing Regulation, Article 97(3), provides that the cessation decision is taken individually. However, where family members were granted status on the same ground, their statuses are ended by the same decision.
If status has ended and, under the other provisions of the Law, the person no longer has a right to stay after the final decision, a deportation decision may be issued under Law 6458 on Foreigners and International Protection, Article 54(1)(i).
