Do domestic laws and policies provide for the cancellation of refugee status?
Assessment by population
Analysis
Domestic law provides for cancellation of an international protection status in Law 6458 on Foreigners and International Protection, Article 86.
The Law does not set out a separate reopening procedure or express time limit, but Article 86 provides for cancellation where, after international protection status has been granted, it is established that one of the statutory cancellation grounds applies.
Law 6458 on Foreigners and International Protection, Article 86(1)(a) provides that status shall be cancelled where it is understood that the person obtained status by presenting false documents, fraud, deceit, or by withholding facts that led to the granting of the status.
Law 6458 on Foreigners and International Protection, Article 86(1)(b) provides that status shall be cancelled where, following the recognition of the status, the beneficiary is found to be among those who should have been excluded under Law 6458 on Foreigners and International Protection, Article 64.
The key exclusion provisions in Article 64 include:
- Article 64(1)(c), where there is strong evidence to believe the person is guilty of offences specified in paragraph one of Article 1(F) of the 1951 Refugee Convention
- Article 64(3), which links inhuman acts committed before the international protection claim to the assessment under Article 64(1)(c)
- Article 64(4), which extends exclusion to instigators and other participants in the crimes or acts
- Article 64(5), which adds subsidiary protection specific exclusion grounds, including serious indications of posing a public order or public security threat, and having committed a serious crime and leaving the country of origin solely to avoid punishment.
The cancellation grounds in Law 6458 on Foreigners and International Protection, Article 86 apply across international protection statuses. However, cancellation through Article 86(1)(b) operates through the structure of Article 64, and Article 64(5) contains additional exclusion grounds that apply specifically to subsidiary protection.
The Law does not establish cancellation criteria that differ by age, gender, or other personal characteristics.
Cancellation removes the legal basis for the person’s international protection status. In practical terms, this affects documentation and the entitlement architecture attached to status, including identity documentation issued under Law 6458 on Foreigners and International Protection, Article 83 and travel documents under Article 84. Cancellation applies to a status determination that has become final and invalidates a status that should not have been granted in the first place. Although the Law does not expressly use the terms "ab initio" or "ex tunc", cancellation in principle operates retroactively, rendering the status null and void from the date of the original determination.
The Implementing Regulation provides that cancellation decisions are taken individually. However, where family members were granted status on the same ground, their statuses are cancelled by the same decision (Article 98(4)).
If the cancellation becomes final and the person has no other right to remain, a deportation decision may be issued under Law 6458 on Foreigners and International Protection, Article 54(1)(i), which expressly includes persons whose international protection status has ended or has been cancelled.
A cancellation decision must be notified together with its material reasons and legal grounds, and the person must be informed of consequences and appeal time limits where they are not represented by a lawyer (Law 6458 on Foreigners and International Protection, Article 86(2)).
Administrative review and judicial appeal are regulated in Law 6458 on Foreigners and International Protection, Article 80, including the possibility of applying to the International Protection Assessment Commission within ten days and bringing a judicial appeal within the relevant time limits. Where administrative review or judicial proceedings are brought, the person is allowed to remain in Türkiye until the review or judicial process is concluded.
