Description

By repealing the Public Servants (Marriage with Foreign Nationals) Ordinance, 1976 (Ordinance No. LVII of 1976) Bangladesh enacted the Public Servants (Marriage with Foreign Nationals) Act, 2015. With this law, no public servants will be able to marry or give assurance of marrying any foreign national without taking permission from the president. Under this Act, section 2(c) gives a broader definition of 'Marriage' and includes a marriage solemnized under any law or any religious customs and practices. The Act requires the public servants to get President's approval to get married to any foreigner. Non compliance with this will cause the loss of public service.

Section 2: Definitions

In this Act, unless there is anything repugnant in the subject or context-
(a) “nationalized enterprise” means any corporation or any commercial of industrial enterprise including a bank which, or the entire or majority of the share in which is owned or held by, or vested in, the Government or any local authority;
(b) “foreign national” means a person who is not a citizen of Bangladesh;
(c) “marriage” means matrimonial relationship entered into under any law for the time being in force or by any religious rites and ceremonies, and its grammatical variations and cognate expressions shall be construed accordingly;
(d) “public servant” means any person who is appointed in the service of any local authority or nationalized enterprise.

Section 3: Restriction on marriage with foreign nationals

(1) No public servant shall marry or promise to marry any foreign national except with permission granted under sub-section (2).
(2) The President may, on an application made in this behalf, grant a public servant permission to marry or promise to marry a foreign national.
(3) A public servant who contravenes the provisions of section (1) may, notwithstanding anything contained in any other law or in the terms and conditions of his service, be liable to be removed from service.
