Law of the Republic of Tajikistan on the Legal Status of Foreign Citizens and Stateless Persons establishes the legal framework governing the rights, obligations, and procedures applicable to foreign nationals and stateless persons within the Republic of Tajikistan. It delineates the conditions for entry, stay, and exit, as well as the acquisition of residence permits and citizenship. The Law emphasizes the protection of personal rights, including freedom of movement, family life, and access to legal recourse, ensuring non-discrimination and adherence to international human rights standards.

Part No. 2 of Article 3 - Legal Status of Foreign Citizens and Stateless Persons in the Republic of Tajikistan

1) Foreign citizens and stateless persons in the Republic of Tajikistan enjoy the rights and freedoms established by law and bear obligations and responsibilities on an equal basis with the citizens of the Republic of Tajikistan, except in cases provided by the legislation of the Republic of Tajikistan.

2) Foreign citizens and stateless persons in the Republic of Tajikistan are equal before the law, regardless of nationality, race, gender, language, religious beliefs, political position, social status, education, or property.

3) In relation to citizens of states where the rights and freedoms of citizens of the Republic of Tajikistan are restricted, the Republic of Tajikistan may impose appropriate restrictions.

4) The exercise of rights and freedoms by foreign citizens and stateless persons in the Republic of Tajikistan must not harm the interests of the state, the rights, or the legitimate interests of the citizens of the Republic of Tajikistan and other persons.

Article No.3 - Legal Status of Foreign Citizens and Stateless Persons in the Republic of Tajikistan

1) Foreign citizens and stateless persons in the Republic of Tajikistan enjoy the established rights and freedoms, and bear obligations and responsibility on an equal basis with the citizens of the Republic of Tajikistan, except in cases provided for by the legislation of the Republic of Tajikistan.

2) Foreign citizens and stateless persons in the Republic of Tajikistan are equal before the law, regardless of nationality, race, gender, language, religious beliefs, political position, social status, education, and property.

3) In relation to the citizens of states where the rights and freedoms of the citizens of the Republic of Tajikistan are violated, the Republic of Tajikistan establishes appropriate restrictions.

4) The use of rights and freedoms by foreign citizens and stateless persons in the Republic of Tajikistan should not harm the interests of the state, the rights, and legitimate interests of citizens of the Republic of Tajikistan and other persons.

Article 7 - Right to Work

1) The employment activity of foreign citizens and stateless persons is regulated in accordance with the legislation of the Republic of Tajikistan.

2) Foreign citizens and stateless persons who have entered the Republic of Tajikistan for temporary residence may engage in specific employment activities, provided that such activities are consistent with the purpose of their stay in the Republic of Tajikistan.

3) Foreign citizens and stateless persons have the same rights and obligations in labor relations as the citizens of the Republic of Tajikistan.

4) The employment activity of foreign citizens in the Republic of Tajikistan can be carried out based on permits issued by the authorized state bodies.

5) The rules for issuing work permits to foreign citizens engaged in employment in the Republic of Tajikistan, as well as the form of the permit document, are approved by the Government of the Republic of Tajikistan.

Article 9 - Right to Health Protection

Foreign citizens and stateless persons in the Republic of Tajikistan have the right to health protection.

The procedure for providing medical assistance to foreign citizens and stateless persons who have arrived in the Republic of Tajikistan for temporary residence is determined by the legislation of the Republic of Tajikistan.

Foreign citizens and stateless persons shall insure their life and health in accordance with the procedure and conditions established by the legislation of the Republic of Tajikistan.

Article No. 11 - Right to Housing

1) Foreign citizens and stateless persons in the Republic of Tajikistan have the right to receive housing for temporary use in accordance with the housing legislation of the Republic of Tajikistan.

2) Foreign citizens and stateless persons do not have the right to acquire ownership of buildings, residential houses, or other premises that are part of the housing fund (except for inheritance by legal heirs), unless otherwise provided by the legislation of the Republic of Tajikistan or international legal acts recognized by Tajikistan.

3) The rules for providing real estate for the placement of diplomatic missions, equivalent representations of international organizations, and consular institutions of foreign states in the Republic of Tajikistan are determined by the President of the Republic of Tajikistan.

Article 12 - Property and Personal Non-Property Rights

Foreign citizens and stateless persons in the Republic of Tajikistan may own personal property, inherit and bequeath property, hold copyright to scientific works, literary and artistic works, discoveries, inventions, industrial designs, as well as other property and non-property rights, unless otherwise provided by the legislation of the Republic of Tajikistan.

Article 13 - Right to Education

Foreign citizens and stateless persons residing in the Republic of Tajikistan have the right to receive education on an equal basis with the citizens of the Republic of Tajikistan, in accordance with the procedures established by the legislation of the Republic of Tajikistan.

Article 14 - The Right to Use Cultural Achievements

1) Foreign citizens and stateless persons in the Republic of Tajikistan have the right to access and benefit from cultural achievements on an equal basis with the citizens of the Republic of Tajikistan.

2) Foreign citizens and stateless persons in the Republic of Tajikistan are required to treat historical and cultural monuments, as well as other cultural values of the Republic of Tajikistan, with care and respect.

Article 15 - Participation in Public Associations

Foreign citizens and stateless persons permanently residing in the Republic of Tajikistan have the right, on an equal basis with the citizens of the Republic of Tajikistan, to join trade unions, scientific, cultural, and sports societies, as well as other public associations, except for political parties, provided that this does not contradict the founding documents of these associations and the legislation of the Republic of Tajikistan.

Article 16 - Freedom of Conscience

1) Foreign citizens and stateless persons are guaranteed freedom of conscience on an equal basis with the citizens of the Republic of Tajikistan.

2) It is prohibited to incite hostility and hatred based on religious affiliation.
