Analysis

Turkish domestic law establishes a framework regulating the presence of individuals seeking international protection and contains explicit provisions enabling persons processed under international protection procedure to stay in the country until a final decision is made regarding them. This framework is primarily grounded in the Law 6458 on Foreigners and International Protection, its Implementing Regulation, and, in cases of mass influx, the Temporary Protection Regulation.

Law 6458 on Foreigners and International Protection Article 76 provides that, once registration is completed, an International Protection Applicant Identity Document is issued to the applicant and, where relevant, accompanying family members, and that the validity period and extension arrangements are regulated by the Ministry. The identity document is not subject to a fee and substitutes for a residence permit. In addition, the Implementing Regulation provides two stage documentation confirming lawful stay without a residence permit: after registration, Implementing Regulation Article 71(1) provides for issuance of an International Protection Application Registration Certificate which confers a right to stay while valid; after the interview is completed, Implementing Regulation Article 90(2) provides that the International Protection Applicant Identity Document likewise confers a right to stay while valid.

Law 6458 on Foreigners and International Protection, Article 80(1)(e) provides that the person shall be allowed to stay in Türkiye until the completion of the administrative review process or judicial proceedings in relation to decisions taken under the international protection procedure. This provision is the clearest statutory expression of a right to remain while remedies against international protection decisions are pending.

For persons covered by temporary protection, Temporary Protection Regulation, Article 25(1) provides that the temporary protection identity document confers a right to stay in Türkiye. The same provision also clarifies that this document is not equivalent to a residence permit or a document substituting a residence permit, does not provide a right to transition to long term residence, and does not count toward residence periods. This still amounts to a clear legal authorization to remain for as long as temporary protection continues.

However, the right to remain pending the procedure is not unconditional. Law 6458 on Foreigners and International Protection, Article 71 provides for administrative obligations such as residence and reporting duties, and noncompliance can have procedural consequences including the application being considered withdrawn under Article 77, which may in turn affect the person’s legal position and exposure to deportation procedures. Even in such cases, however, where an administrative appeal or judicial remedy is pursued, Article 80(1)(e) allows the person to stay in Türkiye until the appeal or judicial process is finalised.
