Do domestic laws and policies provide for efficient asylum procedures on appeal?

Analysis
Law 6458 on Foreigners and International Protection, Article 80 provides rules on administrative objection and judicial review. Under Article 80(1)(a), the person concerned, their legal representative, or their lawyer may lodge an objection with the International Protection Assessment Commission within ten days from notification of the decision. However, decisions taken under Article 68, Article 72, and Article 79 are excluded from this administrative objection route and may be challenged only through judicial remedies. Under Article 80(1)(ç), excluding the judicial remedy set out in Article 68, a challenge against decisions taken under Article 72 and Article 79 must be brought before the competent administrative court within fifteen days from notification, while challenges against other administrative decisions and acts must be brought within thirty days.
Law 6458 on Foreigners and International Protection, Article 80 also contains an efficiency guarantee for a defined category of appeals. Article 80(1)(d) provides that court applications lodged against decisions taken under Article 72 and Article 79 must be finalized within fifteen days, and the court decision is final. This is the clearest statutory mechanism intended to ensure speed on appeal in those categories.
Law 6458 on Foreigners and International Protection, Article 80(1)(e) provides that the person shall be allowed to remain in Türkiye until the objection or judicial proceedings are concluded. In formal terms, this reduces pressure for very rapid litigation simply to prevent removal, and it supports orderly handling of appeals.
At the same time, efficiency is uneven across the appeal system. Practice focused reports that indicate that there are no specific time limits under the Law 6458 on Foreigners and International Protection for administrative courts to decide on judicial appeals against negative decisions in the regular procedure. It is also reported that the Commission step is often not used in practice and has been considered ineffective by practitioners, which can undermine the practical efficiency of the internal review route.1
