Do domestic laws and policies provide for the exclusion from refugee status who are deemed ‘undeserving’ of international protection as refugees?
Assessment by population
Analysis
The Migration and Aliens Law establishes exclusion clauses related to the commission of certain serious crimes or acts (Article 43). These provisions apply where there are serious reasons for considering that the applicant has committed a crime against peace, a war crime, a crime against humanity, a serious common crime committed outside Honduras prior to applying for refugee status and punishable under Honduran law or acts contrary to the purposes and principles of the United Nations.
These exclusion clauses apply independently from the assessment of the refugee inclusion criteria set out in Article 42 of the Law.
