Family life

Turkish law recognizes family related interests through several routes, but the framework remains fragmented. Family members are generally defined narrowly as the spouse, minor child and dependent adult child, and same sex spouses are not recognized for these purposes. For recognized refugees and subsidiary protection beneficiaries, family unity is mainly addressed through the family residence permit framework, while temporary protection beneficiaries have a specific family reunification mechanism. International protection applicants are protected only where family members are already accompanying them in Türkiye; there is no mechanism for bringing family members from abroad during the application stage.

Domestic law provides mechanisms to identify unaccompanied children and includes child specific safeguards, but it does not establish automatic derivative refugee status, a dedicated entry visa or travel document route for family members abroad for family reunification, or a specific administrative assistance duty where support from the country of origin is unavailable. In removal proceedings, family life and family unity are not clearly codified as mandatory factors in every deportation decision, although child safeguards apply in some contexts. Remedies are available mainly through ordinary administrative litigation, but there is no dedicated family reunification appeal mechanism.

Overall, Turkish law protects family unity in specific contexts, but not through a comprehensive framework applicable to all forcibly displaced and stateless persons.
