Dominica is located in the Caribbean Sea, between the French overseas territories of Guadeloupe and Martinique. While Dominica is not a primary country of origin for refugees or stateless persons, its geographic location in the Caribbean places it within regional migration patterns.
Dominica is a signatory to the 1951 Refugee Convention and its 1967 Protocol but the country does not have a specific legal framework for the determination of refugee status. Dominica has not established formal procedures for asylum seekers to apply for refugee status. Consequently, there are no statutory protections for individuals seeking asylum. Asylum seekers without legal status are not authorised to work but may have access to primary education and emergency healthcare services.
...Dominica has not acceded to neither the 1954 Convention relating to the Status of Stateless Persons nor the 1961 Convention on the Reduction of Statelessness. The country also does not have any legislation for the identification and protection of stateless persons. There are no set processes for individuals to apply for recognition of statelessness or established rights or entitlements for stateless individuals. As such, stateless persons in Dominica may face challenges in accessing basic rights and services.
This gap in the law therefore presents key challenges in ensuring the protection and rights of both refugees and stateless individuals in Dominica.
