Ecuador has a Constitution that recognizes the right to identity, to civil registration, and to access to documentation as essential elements for the exercise of rights. On this basis, Ecuadorian regulations, including the Organic Law on the Management of Identity and Civil Data, the Organic Law on Human Mobility, and their respective regulations, create a system that governs birth registration, the registration of vital events, the issuance, renewal, and replacement of identity documents, and access to administrative and judicial remedies against negative decisions. The legal framework also includes mechanisms for immediate and late birth registration, for registering vital events that occurred inside and outside the country, and for issuing travel documents to persons recognized as beneficiaries of international protection. It further provides administrative and judicial avenues and jurisdictional guarantees for reviewing decisions on registration and documentation matters. It bears noting that, through binding case law with inter partes effects but accompanied by exhortations to public institutions, the Constitutional Court has established the obligation to guarantee the right to identity and access to civil registration without discrimination for refugee and migrant populations, including in contexts of vulnerability, particularly in Judgments No. 2185-19-JP and consolidated cases/21 and No. 352-22-EP/24.
In matters of international protection, the legal order governs the documentation of asylum-seekers, refugees, and stateless persons. Full access to the civil identification system, however, depends on formal recognition of refugee status, which is tied to the international protection visa granted by the State. During the refugee status application stage, the documentation issued by the human mobility authority attests to regular stay through a temporary visitor visa, but it does not constitute a civil identity document, which limits access to certain administrative and civil acts, even though it meets the standards for a regular stay in the territory while the application is being processed.
Taken together, the Ecuadorian system establishes a broad and functional regulatory structure on documentation and identity, although it operates mainly through general procedures and through formal recognition of migratory status or of international protection.
