Analysis

Yes. The Honduran legal framework provides for the admission, stay, and protection of persons seeking international protection. At the constitutional level, Article 101 of the Constitution expressly recognizes that: “Honduras recognizes the right of asylum.”
In addition, the Migration and Aliens Law (Decree No. 208-2003) incorporates both asylum and refugee status into the national legal framework. Article 3 defines an asylee as a foreign national to whom the State of Honduras grants asylum in accordance with the Constitution, international treaties, and applicable international practice, while also recognizing refugee status in accordance with international instruments in force for Honduras.
The Regulations to the Migration and Aliens Law establish the substantive criteria and procedures for refugee status determination. Article 45 provides that applications for refugee status may be submitted before the competent migration authority, currently the National Institute of Migration (INM), and is not limited to persons seeking protection at the time of entry into Honduran territory.
Access to international protection is further safeguarded by Article 49 of the Regulations, which prohibits the rejection or return of asylum-seekers and refugees at borders, ports, and airports when such measures could expose them to persecution or other serious harm. In addition, Article 51 of the Regulations establishes that persons seeking refugee status shall not be sanctioned solely on the basis of their irregular entry or stay when seeking international protection.

Due to being stateless and for the reasons set forth in the preceding numeral, they are outside the country in which they had their habitual residence, and are unable or, owing to such fears, unwilling to return to it; 3. Furthermore, foreigners who are legally within Honduran territory and feel threatened by the reasons expressed in the preceding article may request a special permanence permit as refugees.
