Analysis

The national legal framework reviewed does not contain an express provision establishing prima facie refugee recognition procedures. The Regulations to the Migration and Aliens Law provide for individual interviews and case assessment procedures, including the examination of the facts and circumstances relevant to refugee status determination (Articles 46 and 47). Accordingly, refugee status determination in Honduras is primarily structured around the individual assessment of applications and the examination of the particular circumstances of each case.
