Do domestic laws and policies provide for the recognition of refugee status on a prima facie basis?
Assessment by population
Analysis
UK domestic laws and policies do not provide for the recognition of refugee status on a prima facie basis. Paragraph 339J of the Immigration Rules states that the assessment of a protection claim is to be carried out on an individual basis.1
There is no statutory provision or administrative scheme that automatically grants refugee status to individuals based solely on membership of a particular group or nationality, even if the general circumstances in their home country indicate widespread persecution.
