Do domestic laws and policies provide for fair asylum procedures on appeal?
Assessment by population
Analysis
Burkina Faso’s domestic laws establish a legal framework providing access to asylum procedures for people seeking asylum, primarily under Law No. 042-2008/AN of 23 October 2008.
According to Article 13 of Decree No. 2011-119/PRES/PM/MAECR of 2011 on the implementation of the Law on the Status of Refugees in Burkina Faso, any asylum-seeker whose application has been rejected may appeal the decision if there are new elements and if this decision is not based on national security or serious fault. The appeal must be filed with the National Coordinator of the National Commission for Refugees (CONAREF) within sixty days from the notification of the challenged decision (Article 14) and it takes place before the Appeal Committee of the CONAREF (Article 17 and following). The asylum-seeker continues to enjoy the rights as asylum-seeker (Article 15). The asylum-seeker must appear in person before the Appeal Committee (Article 19). The procedure is free of charge (Article 19).
