Analysis

Yes. The Honduran legal framework provides for asylum procedures with review and appeal safeguards. The Regulations to the Migration and Aliens Act establish the procedure for the recognition of refugee status and designate the competent authority responsible for receiving and processing applications for international protection (Article 45). Furthermore, the Regulations incorporate the Administrative Procedure Act (Decree No. 152-87) as a complementary legal framework (Article 146), meaning that administrative decisions are subject to review for potential violations of the legal order, due process, or fundamental rights.

Accordingly, asylum seekers may lodge the administrative remedies available under the Administrative Procedure Act, which applies subsidiarily to special proceedings pursuant to its Article 2. Procedural guarantees include notification of decisions, the opportunity to submit or request additional evidence, the obligation of authorities to address all issues raised by the applicant, and the principle that an error in the designation of a remedy does not prevent its consideration. In addition, administrative decisions may be subject to judicial review, ensuring an effective review of asylum and refugee status determinations and reinforcing due process protections throughout the procedure.
