Analysis

Under Spanish law, every administrative decision must include the appeals available, the competent authority for processing them and the time limits for their submission (Law 39/2015, Article 88(3)).

Regulation (EU) 2024/1348 establishing a common procedure for international protection in the EU and repealing Directive 2013/32EU (the Procedures Regulation), governs the appeals framework against decisions on international protection as part of the EU Pact on Migration and Asylum applicable since 12 June 2026. In addition, the Instruction of the Undersecretary of the Ministry of Interior of June 11, 2026 lays out the consequences of the application of the EU Pact on Migration and Asylum on the administrative appeal (recurso de reposición)  establishing that this administrative appeal is no longer applicable under the EU Pact.

The right to remain in Spain after an appeal against a rejection of a claim for international protection and the suspensive effect of the appeal is established under articles 67 and 68 of the Procedures Regulation. Spain is currently adapting its domestic legislation on judicial procedures to align it with the Procedures Regulation which is directly applicable.

The Spanish law guarantees judicial independence from the administrative authorities (Spanish Constitution, Article 117(1)), the right to be heard (Law 29/1998, Articles 52-66), the right to free legal advice and representation (Law 1/1996, Article 2(e)), the right to access case files and evidence (Law 29/1998, Article 48), and the right to a written, reasoned decision (Spanish Constitution, Article 120(3) and Law 29/1998, Articles 67-73). Under judicial appeal, the continuation of the right to stay in Spain has to be requested by the claimant as a cautionary measure and accepted by the court (Law 29/1998, Articles 129, 131 and 132 and Procedures Regulation article 68).

The procedural safeguards on administrative and judicial appeal are not subject to any conditions, nor to fees. The general non-discriminatory provisions under the Spanish law, as mentioned in previous sections, apply.
