Analysis

Although it does not directly address the exclusion of persons who do not need international protection, Article 5 of the Organic Law on Refugees and Asylees provides that refugee status shall be recognized for persons who, in fact, require such protection. In addition, Article 10 of the same law establishes the grounds that may lead to the cessation of refugee status, several of which imply the end of the situation that gave rise to the need for international protection or the receipt of protection by third States

    Legal provision

Article 5 - Interpretation of the Law

(Unofficial translation) The Venezuelan State shall consider as a refugee any person to whom the competent authority grants such status, by virtue of having entered the national territory due to well-founded fears of being persecuted for reasons of race, sex, religion, nationality, membership of a particular social group, or political opinion, and who is outside the country of their nationality and cannot or does not wish to avail themselves of the protection of that country; or who, lacking nationality, cannot or does not wish to return to the country where they previously had their habitual residence.

Article 10 - Refugee condition cessation

"(Unofficial translation) ""The status of refugee shall cease in the following cases: a) If the person has voluntarily returned to the protection of the country of their nationality; b) If, having lost their nationality, they have voluntarily regained it; or c) If they have acquired a new nationality and enjoy the protection of the country of their new nationality; d) If they have voluntarily returned to the country they had left or from which they had remained for fear of persecution; e) If, because the circumstances under which they were recognized as a refugee have ceased to exist, they can no longer refuse to avail themselves of the protection of the country of their nationality."
