Do domestic laws and policies provide for the cancellation of refugee status?
Assessment by population
Analysis
Article 80 of the Regulations to the Migration and Aliens Law provides for the cancellation of residence authorizations and Special Residence Permits where the information, statements, reports, or documents submitted by the beneficiary are subsequently proven to be false. However, the provision does not expressly regulate the cancellation of refugee status itself, nor does it establish a specific procedure for reviewing refugee status determinations.
The legal framework reviewed does not contain detailed provisions governing the cancellation of refugee status on the basis of fraud, material error, or the subsequent identification of exclusion grounds. In the absence of specific refugee-status provisions, the review, annulment, and revocation of administrative decisions would be subject to the general rules established under the Law on Administrative Procedure, including Articles 119 to 124 concerning the review of administrative acts and the distinction between annulment and revocation.
