Description

The Constitution of Tajikistan establishes the country as a democratic, secular state that emphasizes human rights and equality. It provides for foreign nationals and stateless persons rights comparable to those of citizens, although certain limitations may apply. Article 16 of the Constitution states, "Foreign citizens and stateless persons enjoy the rights and freedoms and have the responsibilities and duties of citizens of
Tajikistan except in cases stipulated by law. Tajikistan will offer political asylum to foreign citizens whose human rights are violated."

Article 35 - Right to work

Everyone has the right to work, choose a profession, employment, labor protection, and social protection against unemployment. Wages must not be lower than the minimum wage.

Any restrictions in labor relations are prohibited. Equal pay must be provided for equal work.

No one can be subjected to forced labor except in cases defined by law.

The employment of women and minors in heavy and underground work, as well as in jobs with hazardous working conditions, is prohibited.

Article No.32

Everyone has the right to own property and the right to inherit.

No one has the right to deprive or limit a citizen's right to property. The confiscation of personal property for public needs by the state is allowed only on the basis of law and with the consent of the owner, with full compensation for its value.

Material and moral damages caused to an individual as a result of illegal actions by government authorities, public organizations, political parties, other legal entities, or private individuals, are to be compensated in accordance with the law at their expense.

The rights and freedoms of individuals and citizens are regulated and protected by the Constitution, the laws of the Republic, and international legal acts recognized by Tajikistan.

The rights and freedoms of individuals and citizens are exercised directly. They define the goals, content, and application of laws, the activities of legislative, executive, and local government bodies, and are ensured by the judiciary.

Restrictions on the rights and freedoms of individuals and citizens are allowed only to ensure the rights and freedoms of other citizens, public order, protection of the constitutional system, national security, defense of the country, public morality, public health, and the territorial integrity of the Republic.
