Description
This Law is intended to regulate matters of Refuge and Asylum in accordance with the terms enshrined in the Constitution of the Bolivarian Republic of Venezuela and in international instruments on refuge, asylum, and human rights, ratified by the country.
Selected provisions
"(Unofficial translatio) The status of refugee shall not be granted to persons falling under the following circumstances:
1. Those who have committed crimes against peace, war crimes, or crimes against humanity, as defined in international instruments.
2. Those involved in ordinary crimes committed outside the country of refuge that are incompatible with refugee status.
3. Those guilty of acts contrary to the purposes and principles of the United Nations."
"La condición de refugiado o refugiada no será reconocida a las personas comprendidas en los supuestos siguientes:
1. Que hayan cometido delitos contra la paz, crímenes de guerra o contra la humanidad, definidos en los instrumentos internacionales.
2. Que estén incursos en delitos comunes cometidos fuera del país de refugio y sean incompatibles con la condición de refugiado o refugiada;
3. Que sean culpables de actos contrarios a las finalidades y a los principios de las Naciones Unidas"
(Unofficial translation) Voluntary renunciation, falsity of the stated grounds, or the existence of facts that, had they been known at the time of recognition, would have resulted in a negative decision, will be grounds for the loss of refugee status. Inaccurate statements do not constitute sufficient grounds for denying refugee status, and it is the responsibility of the National Refugee Commission to evaluate the circumstances of the case.
La renuncia voluntaria, la falsedad de los fundamentos alegados, o la existencia de hechos que, si hubieran sido conocidos al momento de reconocimiento, darían como resultado una decisión negativa, serán causales de la pérdida de la condición de refugiado o refugiada. Las declaraciones inexactas no constituyen suficiente motivo para negar la condición de refugiado o refugiada y le corresponde a la Comisión Nacional para los Refugiados evaluar las circunstancias del caso.
(Unofficial translation) Refugees may only be expelled from the national territory when they commit acts that disrupt public order or affect national security. The act by which this measure is issued must be justified and notified to the refugee, so that they may exercise the remedies provided for by law.
Los refugiados o refugiadas sólo podrán ser expulsados del territorio nacional cuando incurran en hechos que alteren el orden público o afecten la seguridad nacional. El acto mediante el cual se dicte esta medida deberá ser motivado y notificado al refugiado o refugiada, a fin de ejercer éste (a) los recursos previstos en la Ley.
(Unofficial translation) Any person requesting refugee status may not be rejected or subjected to any measure that compels them to return to the territory where their life, physical integrity, or personal liberty is at risk due to the reasons mentioned in Article 5. However, the benefits of this provision may not be invoked by a person who is considered, for well-founded reasons, a danger to the security of the Republic or who, having been sentenced to death for a particularly serious crime, constitutes a threat to the community of the country.
Toda persona que solicite la condición de refugiado o refugiada no podrá ser rechazada o sujeta a medida alguna que le obligue a retornar al territorio donde su vida, integridad física o su libertad personal esté en riesgo a causa de las razones mencionadas en el artículo 5. Sin embargo, no podrá invocar los beneficios de la presente disposición la persona que sea considerada por razones fundadas como un peligro para la seguridad de la República o que habiendo sido objeto de una sentencia definitiva por un delito particularmente grave, constituya una amenaza para la comunidad del país.
(Unofficial translation) If a refugee expresses to the Commission their wish to be repatriated, the competent authority shall issue the necessary travel document for their repatriation, if they are unable to obtain it from the Diplomatic or Consular Mission of their country of nationality.
Al refugiado o refugiada que manifieste ante la Comisión su voluntad de ser repatriado (a), la autoridad competente deberá expedirle el documento de viaje necesario para su repatriación, si no pudiere obtenerlo de la Misión Diplomática o Consular del país de su nacionalidad.
Asylum may also be granted to a person who requests it at Venezuelan diplomatic missions, warships, and military aircraft, in accordance with the international treaties and agreements on the matter to which Venezuela is a party.
(Summary) The Ministry of Foreign Affairs, upon the opinion of the competent national authorities, is responsible for deciding whether asylum is granted.
The provisions of this Law shall be interpreted in accordance with the Universal Declaration of Human Rights of 1948, the 1967 Protocol relating to the Status of Refugees, the American Convention on Human Rights of 1969, the Caracas Convention on Territorial Asylum of 1954, the Caracas Convention on Diplomatic Asylum of 1954, and the other provisions contained in the international human rights instruments ratified by the Republic. In case of doubt in the interpretation or application of any rule, the interpretation most favorable to the enjoyment or exercise of the rights of the applicant for refuge or asylum, or of the refugee or asylee, shall apply.
(Unofficial translation) "The Bolivarian Republic of Venezuela recognizes and guarantees the right to asylum and refuge, in accordance with the following principles:
6. The unity of the refugee or asylum seeker's family will be guaranteed, and especially the protection of unaccompanied or separated refugee children and adolescents, under the terms established in this Law."
"La República Bolivariana de Venezuela reconoce y garantiza el derecho de asilo y refugio, de conformidad con los siguientes principios:
6. Se garantizará la unidad de la familia del refugiado o de la refugiada, del asilado o de la asilada, y de manera especial la protección de los niños refugiados o de las niñas refugiadas y adolescentes no acompañados o separados del núcleo familiar, en los términos establecidos en esta Ley.

(Unofficial translation) With regard to the protection of the refugee's family unit, this includes, when required, their parents, spouse or partner in a stable de facto relationship, and minor children. The situation of other family members will be assessed on a case-by-case basis.
En lo que se refiere a la protección de la unidad familiar del refugiado o refugiada, quedan amparados, cuando sea requerido, sus progenitores, su cónyuge o la persona con quien mantiene una unión estable de hecho y sus hijos menores de edad. La situación de otros familiares será valorada individualmente.
