Description
The Law on legal status of foreign citizens and stateless persons in the Republic of Uzbekistan defines the rights, freedoms, and obligations of foreign nationals and stateless persons residing or staying in Uzbekistan. It establishes their legal status, including entry, stay, transit, and exit procedures, as well as the conditions for employment, social protection, and access to legal remedies. The law ensures that they are equal before the law, subject to Uzbekistan’s legislation and international agreements. It also regulates state control over their movement and residence while outlining procedures for compliance and enforcement by relevant authorities.
Selected provisions
Foreign citizens and stateless persons on the territory of the Republic of Uzbekistan are guaranteed rights and freedoms in accordance with international law. They are subject to the obligations established by the Constitution, laws, and international treaties of the Republic of Uzbekistan.
Foreign citizens and stateless persons on the territory of the Republic of Uzbekistan are equal before the law, regardless of gender, race, nationality, language, religion, beliefs, social origin, or social status.
Foreign citizens and stateless persons who permanently reside in other countries and are temporarily staying in the Republic of Uzbekistan may reside temporarily based on their valid travel documents in accommodations, other residential premises of their choice, or medical institutions.
Foreign citizens and stateless persons who permanently reside in other countries and are temporarily staying in Uzbekistan must register at their place of temporary stay.
The procedure for registering foreign citizens and stateless persons who permanently reside in other countries at their place of temporary stay in Uzbekistan is determined by the Cabinet of Ministers of the Republic of Uzbekistan.
Foreign citizens and stateless persons may permanently reside in the Republic of Uzbekistan.
Foreign citizens and stateless persons who permanently reside in Uzbekistan must register at their place of permanent residence in accordance with the legislation.
Foreign citizens and stateless persons who are permanently registered at their place of residence in Uzbekistan are issued an identification card for foreign citizens and stateless persons permanently residing in Uzbekistan.
The procedure for issuing and processing identification cards for foreign citizens and stateless persons is determined by the President of the Republic of Uzbekistan.
An identification card is issued to:
Foreign citizens or stateless persons permanently residing in the Republic of Uzbekistan upon reaching the age of sixteen or, at the discretion of parents or guardians, from birth until the age of sixteen;
Individuals who have obtained permission for permanent residence in the Republic of Uzbekistan, including those who entered Uzbekistan and whose Uzbek citizenship has been terminated in accordance with the Law "On Citizenship of the Republic of Uzbekistan";
Persons permanently residing in Uzbekistan who have not acquired Uzbek citizenship or whose Uzbek citizenship has been terminated under the Law "On Citizenship of the Republic of Uzbekistan";
Foreign citizens who have legally acquired real estate in Uzbekistan;
Foreign citizens or stateless persons, including founders (participants) of enterprises with foreign investments who have invested in the establishment of production and service enterprises in Uzbekistan, as well as their family members, under conditions specified by decisions of the President of Uzbekistan;
Foreign citizens or stateless persons granted political asylum in Uzbekistan, based on the certificate of political asylum.
The identification card is issued for the following periods:
Newborns up to one year old – valid for two years;
Individuals aged one to sixteen years – valid for five years;
Individuals aged sixteen to sixty years – valid for five years;
Individuals over sixty years old – valid for ten years.
Foreign nationals permanently registered in the Republic of Uzbekistan are issued an identification card for a period not exceeding the validity of their national passports.
Foreign nationals, stateless persons, and their family members, as specified in paragraph six of Article 9 of this Law, are issued an identification card for ten years, but not exceeding the validity of their travel documents.
Foreign citizens and stateless persons residing on the territory of the Republic of Uzbekistan have the right to protection from assaults on their honor and dignity, interference in their private life, and the inviolability of their dwelling. No one has the right to enter a dwelling, conduct a search or inspection, or violate the confidentiality of correspondence and telephone conversations except in cases and in the manner provided by the laws of the Republic of Uzbekistan.
Measures of procedural coercion and administrative sanctions may only be applied to foreign citizens and stateless persons on the territory of the Republic of Uzbekistan based on the laws of the Republic of Uzbekistan.
Foreign citizens and stateless persons who are detained or imprisoned in accordance with the legislation of the Republic of Uzbekistan must be informed of their rights and the circumstances that led to their detention or imprisonment.
Foreign citizens and stateless persons have the right to move freely within the territory of the Republic of Uzbekistan in accordance with this Law and other legislative acts of Uzbekistan.
The movement of foreign citizens and stateless persons within Uzbekistan may be restricted in border zones and border areas, where movement is permitted only with authorization from the competent state authorities of Uzbekistan.
The specific conditions for the movement of foreign citizens who enter Uzbekistan based on documents outlined in an international treaty regulating mutual travel of residents of border areas are determined by Uzbekistan’s international agreements.
Foreign citizens and stateless persons enjoy property rights on the territory of the Republic of Uzbekistan on an equal basis with citizens of Uzbekistan, unless otherwise provided by the laws or international treaties of Uzbekistan.
Foreign citizens and stateless persons in Uzbekistan have the right to inherit or bequeath property owned by them, as well as to exercise other property and personal non-property rights in accordance with the laws and international treaties of Uzbekistan.
Foreign citizens and stateless persons engaged in labor activities on the territory of the Republic of Uzbekistan enjoy rights and bear responsibilities in accordance with the labor legislation of the Republic of Uzbekistan.
The procedure for foreign citizens and stateless persons to engage in labor activities on the territory of the Republic of Uzbekistan is regulated by the employment legislation of the Republic of Uzbekistan.
Foreign citizens and stateless persons may not be appointed or elected to certain positions or engage in certain types of labor activities if, according to the legislation of the Republic of Uzbekistan, appointment to these positions or engagement in such activities is linked to citizenship of the Republic of Uzbekistan.
Foreign citizens and stateless persons who permanently reside in the Republic of Uzbekistan have the right to a pension on an equal basis with Uzbek citizens, in accordance with the legislation and international agreements of Uzbekistan.
The procedure for providing social security to foreign citizens and stateless persons permanently residing in Uzbekistan who do not have the required work experience for pension entitlement is determined by the Cabinet of Ministers of the Republic of Uzbekistan.
