Abdul Majeed vs The S.H.O. Police Station Naulakha (1989 PLD Lahore 223)

Year: 1989

Type: Other

Rights Category: Freedom of movement

Description

In 1989, the Lahore High Court in Abdul Majeed and another v. The S.H,O, Police Station Naulakha, Lahore, (PLD 1989 Lahore 223) held that the government was justified in restricting the petitioners’ movements who were Afghan refugees and taking them back to refugee camps. The court also stated that ‘in the garb of refugees, foreign agents have entered into the holy land of Pakistan and they are busy in the implementation of their nefarious designs.’ Therefore, the government can act in the security of Pakistan and confine and detain foreigners. However, this judgment was given long before PoR cards and later ACCs were given to refugees.
