In December 2023, the Supreme Court heard a petition in the case of Senator (r) Farhatullah Babar v Federation of Pakistan, through Caretaker Prime Minister of Pakistan, Prime Minister Secretariat (1 November 2023, Islamabad) to halt the expulsion of Afghan refugees. Among the arguments cited, the petitioners contend that the coercive deportation under the IFRP would violate article 4 of the Constitution, the principle of non-refoulement, and relevant jurisprudence developed through international human rights conventions. The case is still being heard by the Supreme Court.
