Do domestic laws and policies authorize asylum-seekers to be present and remain in the country, pending determination of their asylum application?
Assessment by population
Analysis
The Regulations to the Migration and Aliens Law authorize the temporary stay of applicants while their claims are being processed. Pursuant to Article 47, an initial authorization of stay may be granted for up to ninety (90) days and may be extended for an additional thirty (30) days when necessary. In practice, the National Institute of Migration (INM) issues renewable temporary stay authorizations to applicants for refugee status recognition while their cases remain pending. In addition, Article 116 of the Regulations recognizes the right of asylum-seekers and refugee applicants to remain in the country during the examination of their claims.
