Analysis

The Regulations to the Migration and Aliens Law guarantee the right of applicants for refugee status recognition to be heard through an individual and confidential interview (Article 46). Applicants may also be assisted by an interpreter, including one provided through UNHCR support when available and necessary.

The procedure includes an investigation phase conducted by the competent migration authorities to assess the facts and circumstances relevant to the application. During this phase, applicants may submit any documentation or evidence available to support their claim (Article 47).

Under the current institutional framework, applications are reviewed by the Refugee Commission, which issues a technical opinion on the case. This opinion serves as the basis for the issuance of a first-instance administrative resolution by the General Secretariat of the National Institute of Migration (INM), in accordance with the applicable legal and administrative framework. Applicants may challenge a negative decision through the administrative remedies provided under Honduran law.
