Do domestic laws and policies provide for efficient asylum procedures at first instance?
Assessment by population
Analysis
The Regulations to the Migration and Aliens Law provide for an initial temporary stay authorization of up to ninety (90) days for asylum-seekers and applicants for refugee status recognition, which may be extended when necessary (Articles 47, 116 and 117). The Regulations also provide for the establishment of procedures and standardized formats for interviews, investigations and the issuance of temporary permits (Article 47).
While these provisions facilitate access to and continuity of the procedure, they primarily regulate authorized stay during the examination of the claim and do not establish a specific deadline for the issuance of a decision. In practice, the National Institute of Migration (INM) may renew temporary stay authorizations while an application remains pending. Any delays in the issuance or notification of administrative decisions are subject to the general principles and procedural safeguards established under the Law on Administrative Procedure, including Articles 84 and 85 concerning notification requirements and remedies in cases of administrative delay.
