Analysis

The Mexican legal framework provides for several avenues to challenge decisions adopted in refugee status determination procedures, including the administrative review (recurso de revisión), the administrative litigation or annulment proceedings (juicio contencioso administrativo or juicio de nulidad) before the Federal Administrative Justice Tribunal (Tribunal Federal de Justicia Administrativa, TFJA), and amparo proceedings (juicio de amparo). The availability of different review mechanisms is a positive feature of the Mexican asylum system, as it allows administrative decisions to be reconsidered and, where appropriate, subjected to independent judicial and constitutional review.

First, the Law on Refugees, Complementary Protection and Political Asylum expressly provides for an administrative review (recurso de revisión) against negative decisions on refugee status recognition. Article 25 establishes that applicants may file this review within 15 working days following notification of the decision, without prejudice to their right to pursue other available remedies. This mechanism allows the administration itself to review the contested decision without requiring the applicant to immediately initiate judicial proceedings.

One challenge is that the review is decided within the administrative sphere itself, while the relatively short timeframe for filing it makes timely access to information and specialized legal assistance particularly important.

Second, final administrative decisions may also be challenged through administrative litigation proceedings (juicio contencioso administrativo or juicio de nulidad) before the Federal Administrative Justice Tribunal (TFJA). This mechanism constitutes an additional relevant safeguard, as it allows asylum-related decisions adopted by the administrative authority to be reviewed by a judicial body distinct from the authority that issued the decision.

Key challenges include the technically specialized nature of the proceedings, the importance of having access to adequate legal assistance, and the time that may be required to obtain a final decision.

Third, amparo proceedings (juicio de amparo) constitute an additional constitutional safeguard against acts or omissions by public authorities that may violate human rights recognized under the Constitution or international treaties. This remedy is particularly relevant in the asylum context where issues such as due process, access to refugee status determination procedures, delays or omissions by the authorities, or protection against refoulement (non-refoulement) are at stake.

The broad protective scope of amparo proceedings constitutes a significant strength of the Mexican legal system. They may also allow for the adoption of interim measures to prevent irreparable harm while the merits of the case are being decided. However, amparo is a legally complex procedure, and effective access to it may therefore depend to a significant extent on the availability of specialized legal assistance and representation.

Overall, Mexico has a broad framework of administrative, judicial and constitutional mechanisms to challenge decisions and actions related to asylum procedures. The availability of these different avenues constitutes a strength of the system, as it provides for different levels of review and protection of applicants’ rights.

The main areas that could be further strengthened relate to the duration of proceedings, timely access to free and specialized legal assistance, and the need to ensure that applicants are aware of, understand and are able to effectively exercise the available remedies.
