Do domestic laws and policies provide for the continued protection of refugees for whom special arrangements have been made?
Assessment by population
Analysis
Mirroring Article 1D of the 1951 Refugee Convention, the relevant Spanish and EU law under the Qualification Regulation (EU) 2024/1347, exclude persons under the protection or assistance from UN agencies other than UNHCR from the refugee status and the subsidiary protection. If such protection or assistance ceases for any reason and the position of the person concerned has not been settled according to UN General Assembly resolutions, they ipso facto acquire the right to the benefits of asylum. The relevant law does not include provisions that may result in differences of treatment among refugees (Law 12/2009, Articles 8(1); see also Qualification Regulation, Article 12(1a)).
