Analysis

Article 3 of the 1997 Asylum Law mentions exclusion clauses similar to those outlined in Article 1F of the Refugee Convention and the 1969 African Union Convention. Unlike Article 1F of the Refugee Convention, the text of the provision does not expressly require "serious reasons for considering" that the acts have been committed.

The first clause excludes any person who has committed a crime against peace, a war crime, genocide, or a crime against humanity, as defined in international instruments. The second clause excludes any person who has committed a serious non-political crime outside the country of refuge prior to his admission to that country as a refugee. Finally, the third and fourth clauses exclude any person who has been guilty of acts contrary to the purposes and principles, not only of the United Nations but also of the African Union.
