Do domestic laws and policies provide for fair asylum procedures on appeal?
Assessment by population
Analysis
UK domestic law provides a formal appeal system for refused asylum claims that incorporates several core safeguards relevant to fairness.
The refusal of protection claims results in a statutory appeal right to the First-tier Tribunal (Immigration and Asylum Chamber) under section 82 of the Nationality, Immigration and Asylum Act 2002.1 The Tribunal determines appeals in accordance with the statutory scheme at Part 5 of that Act.2
However, asylum claims which the Home Office refuses and certifies to be “clearly unfounded” under section 94 of the same Act do not give rise to a right of appeal to the Tribunal.3 Certification of asylum claims can only be challenged by way of Judicial Review.
Pursuant to the Tribunals, Courts and Enforcement Act 2007,4 the Tribunal Procedure (First-tier Tribunal) (Immigration and Asylum Chamber) Rules 2014 (“the Procedure Rules”)5 contain rules on the appeal procedure, the conduct of hearings, and how the Tribunal is to reach its decisions. The Procedure Rules, along with Practice Directions and Statements, Protocols, Guidance Notes, Directions and other guidance and resources are published on the Courts and Tribunal Judiciary website.6
Many safeguards relevant to asylum appeals are general Tribunal guarantees rather than asylum-specific. Procedure Rule 2 requires the Tribunal to conduct proceedings fairly and justly. This results in practice in many safeguards being present although they are not specifically mentioned in the Procedure Rules or elsewhere in statute.
Hearings may take place orally or on the papers, and the Tribunal has the power to decide the appropriate form of hearing under its case management powers contained in Rule 4. In practice, protection appeals are heard orally, unless the appellant requests for the appeal to be dealt with without a hearing.
Rule 4 gives the Tribunal to power to admit documents, information, evidence or submissions and Rule 14 permits the Tribunal to admit evidence which was not available to the Home Office decision-maker. In practice, evidence will be admitted if it is provided in accordance within Tribunal deadlines and directions, or if the Tribunal considers that it is otherwise fair and just to admit the evidence.
Rule 14 provides for the giving of evidence by witnesses, including expert witnesses. Witnesses and experts may provide written evidence and oral evidence at a hearing.
Although the 2014 Rules do not expressly mention interpreters, an interpreter is provided where necessary for effective participation in the hearing by the appellant. In practice, appellants are asked prior to the hearing whether they require an interpreter and one is provided if requested.
Rule 10 permits appellants to appoint a legal representative to deal with all matters relating to the appeal. Legal representation extends to the presence of legal counsel at a hearing. Under Paragraph 30 of Schedule 1 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012, appellants are entitled to Legal Aid for protection appeals7 where their financial means fall below a certain threshold8 and providing there is a sufficient prospect of the appeal succeeding.9 As in relation to first instance applications, legal advice and representation is not always accessible due to an insufficiency of legal aid providers.10
Safeguards for children and vulnerable appellants when attending hearings are provided for under the Practice Direction on Child, Vulnerable Adult, and Sensitive Witnesses.11
Under section 77 of the Nationality, Immigration, and Asylum 2002 Act, a person may not be removed from the UK while their appeal is pending.12. Section 104 of the same act clarifies that an asylum appeal remains pending until it is finally determined, and it will not be finally determined while there remains a possibility of an in-time application for permission to appeal to a higher court or tribunal, or while a higher court or tribunal is considering the application for permission to appeal or the appeal itself.13
The Tribunal is institutionally independent from the Home Office, sitting in the Ministry of Justice, and therefore the process contains the safeguard that the review of the decision is conducted by a different and impartial authority.14
In June 2026, the Government introduced draft legislation15 which would see the First-tier Tribunal replaced by a body to be known as the Independent Immigration Appeals Authority (IIAA).16 While this body would be separate from the UK Government, it would be sponsored by the Home Office and certain staff members would be appointed by the Home Secretary.17 The Immigration and Asylum Bill provides for the establishing of procedure rules for the IIAA and makes some requirements as to their contents. UNHCR has published observations on the Bill.18
