Description
This law establishes the legal framework for the protection and management of refugees and asylum-seekers in Somaliland.
Selected provisions
Family Members:- Means to the members of the family such as the father, mother, children, and other dependents of the family.
Properly dealing with them, and not repatriating them forcibly.
As soon as the application is received, the registration office will commence reviewing the applications following the provisions of this law, regulations, and other guidelines under this law.
The Authority will give special considerations and expedite decisions on the applications of the most vulnerable people. The vulnerable people include: victims of torture, people who suffered psychological damage, persons with disabilities, people with special needs, children, sexual violence victims, female-headed households, unaccompanied children without a parent or guardian, and other persons requiring special consideration, in accordance with special procedures prescribed by regulations under this Act.
A person is entitled to be granted Refugee status under this Act if: (a) He has crossed an international border and arrived at the border of the Republic of Somaliland, and has a substantial fear based on the punishment he has faced or is afraid of being punished for reasons related to his ethnicity, nationality, religion, gender, and his political opinion, and he is unable or unwilling to return to his country.
Any person whose country is in crisis or war and arrives at the borders of the Republic of Somaliland is automatically recognized as a refugee.
The class of persons to be recognized as Prima Facie Refugee include those whose countries are affected by general problems or wars and declared such class of persons to be prima facie refugees, except for those who are specified in Article 23 of this law.
Every person who is under the age of 15 and is a member of the family of a recognized refugee or asylum seeker and applied to be reunited with his family shall enjoy the same protection as that recognized refugee and shall;
a) be permitted to enter and remain in the Republic of Somaliland for
as long as the recognized refugee is permitted to remain; and
b) be issued with all necessary documents and identification related
to his refugee status in accordance with this Act,
A recognized refugee may apply to the Authority for permission for a member of his or her family to enter and reside in the Republic of
Somaliland for purposes of reunion.
Upon receipt of the application made under paragraph (1) of this
article, the family relationship between the refugee and the person or
persons to whom he requested for permission will be investigated.
