Description
The Constitution of the United Republic of Tanzania establishes the framework for the country's governance, dividing it into the Executive, Legislature, and Judiciary. Article 13 (1) provides that "All persons are equal before the law and are entitled, without any discrimination, to protection and equality before the law" and 13 (2) "No law enacted by any authority in the United Republic shall make any provision that is discriminatory either of itself or in its effect."
Selected provisions
Every person has the right to freedom and to freedom live as a free person.
For the purposes of preserving individual freedom and the right to live as a free person, no person shall be arrested, imprisoned, confined, detained, deported or otherwise be deprived of his freedom save only—
under circumstances and in accordance with procedures prescribed by law; or
in the execution of a judgment, order or a sentence given or passed by the court following a decision in a legal proceeding or a conviction for a criminal offence.
Where any person alleges that any provision of this Part of this Chapter or any law involving a basic right or duty has been, is being or is likely to be contravened in relation to him in any part of the United Republic, he may, without prejudice to any other action with respect to the same matter that is lawfully available, apply to the High Court for redress.
