Assessment by population
Analysis
Burkina Faso’s Law No. 042-2008/AN of 23 October 2008 contains exclusion criteria in Article 5, according to which such a law does not apply to individuals if there are serious reasons to believe they:
- Have committed a crime of genocide, a crime against peace, a crime against humanity, or a war crimes.
- Have committed a serious non-political crime outside Burkina Faso before being admitted as a refugee.
- Have been guilty of acts contrary to the purposes and principles of the African Union (AU) and the United Nations (UN).
Based on the text of the law, the first and third grounds of exclusion may be applied as clauses of revocation. However, an expression procedure of revocation does not exist in Law No. 042-2008/AN of 23 October 2008. According to Article 24 Aof Decree No. 2011-119/PRES/PM/MAECR of 2011 on the implementation of the Law on the Status of Refugees in Burkina Faso, refugee status is withdrawn in the situations contemplated by Article 1F of the 1951 Convention.
Article 14 of the same Law provides that a refugee expelled on grounds of national security or public order will have their status 'withdrawn'.
According to Articles 22 and 23 of Decree No. 2011-119/PRES/PM/MAECR of 2011 on the implementation of the Law on the Status of Refugees in Burkina Faso, the status of refugee is withdrawn if the refugee has left Burkina Faso without their ID card or Convention Travel Document. It may be withdrawn if they seriously threatened national security or public order.
