Do domestic laws and policies provide for efficient asylum procedures at first instance?
Assessment by population
Analysis
Nigerien law has clearly identified the authority responsible for receiving and processing asylum applications. Articles 5 of the 1997 Asylum Law and Article 8 of its 1998 implementing decree designate the National Eligibility Commission for Refugee Status as the body responsible for decision-making regarding the admission, cancellation, or cessation of refugee status.
There is no maximum time limit for the refugee status determination process. According to Article 11 of the 1998 implementing decree, the National Eligibility Commission convenes at the request of its President, the Minister of the Interior, whenever the number or urgency of cases to be examined requires it. Additionally, Article 3 of the 2000 Decree on the Commission's Internal Regulations states that the President sets the date and agenda for the meetings.
